Terms of Service

These Terms of Service (“Terms”) govern your use of the Big Spoon mobile application (the “App”) and the bigspoon.app website (the “Site”), operated by Big Spoon (“we,” “us,” or “our”). By using our services, you agree to be bound by these Terms. If you do not agree, do not use the App.

Eligibility

You must be at least 13 years old (or the age of majority in your jurisdiction, if higher) to use the App. By using the App, you represent that you meet this requirement.

Account

Your account is created through Sign in with Apple. You are responsible for maintaining the security of your Apple ID and for all activity under your account. You may delete your account at any time through the App’s Settings, which will permanently remove all of your data from our servers.

Subscription

Big Spoon Pro

Access to certain features requires an active Big Spoon Pro subscription. Subscriptions are managed entirely through Apple’s App Store as In-App Purchases.

  • Pricing and billing are determined by Apple and displayed at the time of purchase.
  • Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
  • To cancel, go to your device’s Settings > Apple ID > Subscriptions, or manage subscriptions through the App Store.
  • Refunds are handled by Apple in accordance with their refund policies.
  • Deleting your Big Spoon account does not cancel your subscription. You must cancel your subscription separately through Apple.

AI-Generated Content

No Warranty on Accuracy

The App uses artificial intelligence to generate recipes, nutrition information, health scores, meal plans, recipe images, and other content. This content is produced by automated systems and may contain errors, inaccuracies, or omissions. Specifically:

  • Nutrition information (calories, protein, carbohydrates, fat, fiber, sugar, and similar values) is estimated by AI models. These are rough approximations and should not be relied upon for medical, dietary, or health-related decisions.
  • Health scores are AI-generated estimates intended for general informational purposes only.
  • Recipe images are artistic representations generated by AI and may not accurately depict the actual appearance of prepared dishes.
  • Ingredient lists and quantities may be incorrect, incomplete, or inappropriate. Always review recipes carefully before preparing them.
  • Cooking instructions may contain errors, including incorrect temperatures, times, or techniques.

We make no representations or warranties regarding the accuracy, completeness, reliability, or suitability of any AI-generated content.

Not Medical, Nutritional, or Health Advice

Big Spoon is not a medical device, nutritional counseling service, or healthcare provider. Nothing in the App constitutes medical advice, nutritional counseling, dietetic advice, or health recommendations.

You should consult a qualified healthcare professional, registered dietitian, or physician before making dietary changes, especially if you have medical conditions, food allergies, or specific nutritional requirements.

We expressly disclaim any and all responsibility for health outcomes resulting from following any recipe, meal plan, nutrition information, or health score provided by the App.

Food Allergy and Safety Warning

You are solely responsible for ensuring that all food you prepare using information from the App is safe for you and anyone you serve. Specifically:

  • AI-generated recipes may contain allergens that are not explicitly identified, even if you have set allergy preferences.
  • Dietary restriction and allergy filters are best-effort and may not catch all allergens or dietary conflicts.
  • Cross-contamination risks are not assessed by the App.
  • Cooking times, temperatures, and food safety practices suggested by the AI may be inaccurate. You are responsible for ensuring food is prepared and stored safely according to established food safety guidelines.

We are not liable for any allergic reactions, foodborne illness, injury, or adverse health effects resulting from the use of recipes, ingredients, or information from the App.

AI Limitations

AI technology is inherently imperfect. The AI may:

  • Generate recipes using ingredients you have indicated as disliked or restricted.
  • Produce unexpected, incorrect, or inappropriate results.
  • Provide conflicting or inconsistent information across different interactions.

Always review all AI-generated content before relying on it.

User Content

Your Ownership

You retain ownership of the recipes, photos, and other content you create or upload to the App (“User Content”).

Our License

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to store, process, display, and transmit your User Content solely to provide and improve the App. This license terminates when you delete your account.

Your Responsibilities

You represent that you have the right to submit any content you provide. For recipes imported from URLs or other sources, you are responsible for ensuring you have the right to store and use that content.

AI-Generated Content Ownership

Recipes, images, and other content generated by the AI through your use of the App are provided to you without ownership claims by us. Note that the copyright status of AI-generated content may vary by jurisdiction and is subject to evolving law.

Acceptable Use

You agree not to:

  • Use the App for any illegal purpose.
  • Attempt to reverse-engineer, decompile, or disassemble the App.
  • Abuse, overload, or interfere with the AI features or our servers.
  • Circumvent rate limits, usage restrictions, or security features.
  • Share your account with others or create multiple accounts.
  • Use the App to generate content that is harmful, dangerous, abusive, or illegal.

We reserve the right to suspend or terminate accounts that violate these Terms.

Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that:

  • The App will be uninterrupted, timely, secure, or error-free.
  • The results obtained from the App will be accurate or reliable.
  • The quality of any AI-generated content will meet your expectations.
  • Any errors in the App will be corrected.
  • The App will meet your specific dietary, health, or nutritional needs.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BIG SPOON, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE APP.

This includes, without limitation, damages arising from:

  • AI-generated content, including recipes, nutrition information, health scores, and images.
  • Allergic reactions, foodborne illness, or any adverse health effects.
  • Food preparation based on information from the App.
  • Loss of data, profits, goodwill, or other intangible losses.
  • Interruption or unavailability of the App.
  • Unauthorized access to or alteration of your data.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In those jurisdictions, our liability is limited to the fullest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Big Spoon and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of any third party.

Third-Party Services

The App relies on third-party services including Supabase, OpenRouter, Firebase, OneSignal, RevenueCat, and Apple. These services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.

Modifications

We reserve the right to modify the App or these Terms at any time. If we make material changes to these Terms, we will notify you through the App or by other means. Your continued use of the App after such changes constitutes acceptance of the new Terms.

We may also modify, suspend, or discontinue any part of the App at any time, with or without notice, and without liability to you.

Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to warranty disclaimers, limitation of liability, and indemnification.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Indiana, and you consent to the personal jurisdiction of such courts.

General Provisions

  • Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
  • Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
  • Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Big Spoon regarding the App.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
